We may change part or all of the Terms at any time. The most current Terms will always be posted on the website. Your subsequent or continued use of this website will constitute your acceptance of any changes made to these terms. If you object to any of the terms in this document, or to any changes made to them, your only remedy is to immediately cease use of and access to this website.

Purchasing Online

Shipping Costs

Please refer to individual product listings for freight costs. Please take care to ensure the residential or business address provided is correct when you review your purchase prior to confirming your payment. Any re-delivery or additional freight costs are the responsibility of the customer.

Tax Invoices

Statewide 4×4 issues tax invoices for all items purchased in compliance with the laws of Australia. Tax invoices will be sent to your provided email address once checkout and payment has been completed. A copy will also be sent with your item when it is dispatched.

Delivery Times

We will dispatch your goods within 2 business days of your payment being received. You will receive a confirmation once your item has been dispatched with a tracking number. Our items are dispatched via Australia Post or via a courier depending on the item size and weight.

All deliveries by Australia Post and couriers will be made between 9.00am to 5.00pm Monday to Friday. Orders sent via courier must be delivered to a business address only. See below for a general guide to delivery times:

3-5 Working days for delivery to a capital city in any State

5-7 Working days for delivery to most large regional towns

5-10 Working days for delivery to other locations

The above delivery times do not apply during peak periods e.g. Christmas, New Years, Easter and over public holidays. During these times the above delivery times may be extended by delays with Australia Post and Couriers. Please note that these delivery times are estimates only and actual delivery times may vary due to circumstances outside of our control.

Delivery Types

We ship most of our items through Australia Post. For heavier items over 25-30kgs we generally use TNT Express. The majority of our delivery methods will have a tracking service available. You will be notified of your tracking number when your item is dispatched.

Statewide 4×4 and its carriers are unable to provide an exact estimate of delivery times. If you are unsure if you will be available at the delivery address during delivery hours we recommend shipping to a work address or other address where someone will be present during delivery hours. Deliveries must be signed for. Anyone at the nominated delivery address who receives and signs for the consignment shall be presumed by Statewide 4×4 to be authorized to receive the item.

If no one is at the delivery address to receive the item, the courier will leave a notification and you may be liable for a re-delivery fee. When delivered by Australia Post you will usually need to collect your delivery from the nearest Post Office.

 

Courier Delivery Of Oversized & Heavy Items

Due to the limit on large and heavy items with Australia Post, some items cannot be delivered to a residential address or a PO Box and will be delivered by a courier instead. You will need to supply a work or business address for courier delivery.

The delivery address provided must be a business / commercial address open between 9.00am and 5.00pm Monday to Friday. The business address must NOT be a business run from home or from a residential address. If you do not have a business address to ship to the alternative is to have your item shipped to the nearest courier depot for collection. You will need to advise us at the time of purchase that you wish to collect your item from a depot.

Deliveries must be signed for. Anyone at the nominated delivery address who receives and signs for the consignment shall be presumed by Statewide 4×4 to be authorized to receive the item.

Tracking Your Consignment

All of our consignments are sent with tracking numbers. You will be advised of your consignment tracking number after your item has been dispatched. You will be able to track your item online via www.tnt.com.au or www.auspost.com.au/track/

You will be able to view details of your consignment along with estimated delivery dates. We cannot advise or specify an exact delivery time as this is not part of our contract agreements.

Shipping Insurance

Statewide 4×4 provides free shipping insurance on all consignments within Australia regardless of the size or carrier. If your order arrives damaged in any way you must advise us within 2 working days of receiving your item.

Non-Delivery

Sometimes due to circumstances beyond our control and or despite our best efforts, items are not delivered as intended for a number of reasons, including:

Nobody Home: Where our courier is unable to obtain a signature the item will be returned to the carriers local depot or Post Office. You are able to contact the depot via the details provided on the calling card to arrange re-delivery or call into your local post office with your tracking number and I.D. Any re-delivery costs are the responsibility of the customer.

Returns: After unsuccessful attempts to deliver a consignment, the courier or post office may return the item to us. We will then contact you for further instruction. The consignment will only be re-dispatched upon payment for the second shipping charge / re-delivery fees. In the event that the re-delivery charges remain unpaid for more than 30 days your order will be deemed abandoned and may be offered for re-sale or otherwise disposed of with out further notice. In this event you release Statewide 4×4 from any liability whatsoever in respect of your purchase.

Abandoned Goods

If for any reason we are unable to dispatch items for which payment has been received for more than 30 days, the items will be deemed abandoned and we reserve the right to offer them for resale. In this event, you agree that Statewide 4×4 is released from any liability in respect of your purchase. Reasons where items will be deemed abandoned may include:

  1. Where a street address has not been nominated during the checkout process and you have not informed us of a delivery address or change of address.
  2. Where legitimate additional shipping or re-delivery charges have not been paid by the purchaser despite our requests.
  3. Where an item returned under warranty is found to be not claimable (see non-warranty section) and legitimate re-delivery charges have not been paid for more than 30 days despite our requests.

Stock Availability

In the unlikely event that we are out of stock of an ordered item we will contact you as soon as were are aware of the issue. Statewide 4×4 reserves the right to supply ordered products to the earliest paying customer. All subsequent payments will be refunded in full within 3 working days or placed on back order with the purchasers consent where stock can be obtained at a later date. Although Statewide 4×4 will do its best to source these items, we can give no guarantee of future availability of any item and our liability is limited to a full refund of the purchase price of that item and any associated shipping costs.

Accuracy Of Product Description

All products and services listed on this website are described to the best of our abilities and using the information available to us at the time. Care is taken to ensure that this information is correct, but we cannot eliminate the possibility of:

Human error in entry of information

Incorrect information provided to us by suppliers or distributors

Failure of suppliers or distributors to supply updated information to us

We reserve the right to change any information including but not limited to pricing, specifications, descriptions, or product names without notice.

Returns & Exchanges

Please choose carefully as Statewide 4×4 does not accept return of goods where you have simply changed your mind. You can return for a refund or exchange a purchase only when:

  1. As per certain circumstances under warranty
  2. Goods are supplied incorrectly*
  3. Goods vary from their advertised description*

 

Statewide 4×4 must be notified within 2 days or receipt of goods that that are incorrectly supplied or not as described. The goods are to be returned unused and in their original packaging. Please provide a copy of your receipt as proof of purchase. We will pay for return shipping however in some cases you may be required to return the item to a couriers depot as pick up from certain addresses will not be possible.

We advise returning goods to us or the repair agent via registered mail / courier with tracking to ensure their safety and arrival. We do not take responsibility for goods lost or damaged in transit.

Refunds will be issued to the extent required by the Trade Practices Act 1974 (Cwth) and Sale of Goods Act 1958 (Vic). No part of these terms of use is to be taken as an express or implied repudiation of our obligations under these pieces of legislation.

Warranty Policy

All products are covered by the manufacturers warranty. Products with no warranty period as specified by the manufacturer are covered by a 12 month warranty. Most warranty terms are advertised on the manufacturers Australian websites, alternatively contact us and we will be able to provide the warranty details for you.

The warranty period commences on the date of the tax invoice issued to the provided email address. During the warranty period if the products is found to be defective it will be repaired or replaced as for the manufacturers terms and conditions.

If you experience problems with your products within the warranty period, please notify us at [email protected] including a copy of your receipt / proof of purchase and we will confirm the warranty process for that item.

Where an identical item is no longer available or out of stock and a replacement is required, a refund will be offered in full.

Warranty Exclusions

Some factors and circumstances will not be covered by warranty, always refer first  to the product manufacturer for further details. Further to that, warranty does not cover for:

  1. Accidental damage or breakage
  2. Abuse, neglect or misuse of product
  3. As a result of normal wear & tear
  4. Improper installation
  5. Careless handling
  6. Tampering or modification
  7. Any major of minor disassembly or tampering
  8. Rust or oil leaks
  9. Submersions or water damage
  10. Products used in applications for which they were not intended.

All damaged goods due to the above reasons will be also invalid for return and exchange. The sole responsibility of Statewide 4×4 shall be the repair or replacement of any defective items covered under the manufacturers warranty excluding damage or breakage caused by reasons as stated above or as stated by the manufacturer under warranty exclusions.

If an items is sent to us for warranty and deemed not to be covered under warranty terms we will only return the item to the original purchaser once the correct shipping charges have been paid. In the event that such charges remain unpaid for more than 30 days, the goods will be deemed abandoned and may be disposed of at our discretion without any liability to compensate or reimburse the original purchaser.

Warranty Shipping Costs

If your item arrives damaged, DOA or faulty within 7 days, we will pay for the return shipping. In some cases you may be required to return the item to a couriers depot as pick up from certain addresses will not be possible.

If the fault occurs after the first 7 days but within the warranty period, you will need to return the item to us or to a repair agent at your own cost. If the item is deemed to be a warranty repair / replacement then the shipping costs will be refunded. You will need to provide proof of shipping costs.

We advise returning goods to us or the repair agent via registered mail / courier with tracking to ensure their safety and arrival. We do not take responsibility for goods lost in transit.

Payment & Security

All orders on this website must be pre-paid before fulfilment, no COD payments are accepted. All orders are placed in Australian dollars.

In the case that you pay for an order with your credit card, we do not store your credit card number on our servers, however it may be retained by our payment gateway provider in circumstances where this is required.

In the case of offline payment, we will contact you to arrange payment. This process must be completed before your order can ship.

In cases where your payment for an order fails for reasons including but not limited to insufficient card credit, or cheque dishonour, we do not warrant that stock will be held until an alternate payment method is available or the original payment method made to function.

We use industry-standard SSL encryption where applicable to protect the privacy of information in transit between this website, yourself, and our suppliers including payment gateways.

You acknowledge that the security of communications sent by electronic means cannot be guaranteed. You provide information to us via the internet at your own risk. We cannot accept responsibility for misuse or loss of, or unauthorised access to, your personal information where the security of information is not wholly within our control.

Limitation Of Liability

Under no circumstances will we be liable for any direct, indirect, incidental, consequential or other damages resulting from the purchase, delivery, use, or return of any product or service purchased from this website beyond the value of the item purchased, including but not limited to loss of profits or interruption to business.

Minimum Age & Legal Capacity

Purchasing products or services on this website is restricted to individuals 18 years of age or older. Individuals below the age of 18 may have purchases made on their behalf by a parent or guardian.

Should we suffer any loss or damage as a result of a transaction entered into by a minor, we reserve the right to seek compensation for such losses from the parents or guardians of the minor who caused the order to be placed.

These terms shall be construed in accordance with and governed by the laws of Victoria, Australia. You consent to the exclusive jurisdiction of the courts in Victoria to determine any matter or dispute which arises under these terms.

Your access to this website may be suspended without notice in the case of system failure, maintenance or repair or any reason beyond our control.
